Azerbaijan adopts rules on foreigners without immigrant status and persons without citizenship

These rules define rules on withdrawal of foreigners without immigrant status and persons without citizenship out of the borders of Azerbaijan, the Cabinet of Ministers told Trend.

Foreigners, without an immigration status, and persons without nationality can be withdrawn from Azerbaijan at the decision of the Interior Ministry, the State Migration Service or a the verdict of a court in case of gross violation of the legislation on juridical status of foreigners and persons without citizenship.

Rules on withdrawal out of the borders of Azerbaijan are not applied within a year on foreigners without immigrant status and persons without citizenship who suffered as a result of trafficking, and they are eligible to pass registration in accordance with rules determined by legislation. Rules on withdrawal out of Azerbaijan are not applied on children, who have fallen victims of trafficking.

Victims of trafficking, whose personality is impossible to identify, are withdrawn out of the Azerbaijan Republic.

In case foreigners without immigrant status and persons without citizenship hold a document confirming their personality (in case of loss, hiding, etc), relevant work is done to prepare documents and necessary measures are taken to identify their personality in accordance with the existing agreement between the State Migration Service or Interior Ministry and authorized state agencies of foreign countries directly, and by Interior Ministry in other cases.

Until applying rules on withdrawal out of borders of Azerbaijan, requests are sent to computerized information search system 'entry-departure registration' or a unified migration system with regard to define data about personality of foreigners without immigrant status and persons without citizenship to receive necessary information.

Foreigners, not holding a status of immigrant, and people without citizenship must the territory of the Azerbaijan Republic within a period (48 hours), indicated in a decision on their withdrawal out of the country, which was adopted by the State Migration Service and the Interior Ministry.

A decision on obligatory withdrawal of foreigners without immigrant status and persons without citizenship out of the borders of the Azerbaijan Republic is taken in several directions: a foreigner is directed to a country he is a citizen of; while persons without citizenship to a country where he held a permanent registration of residence; to a country from where he/she directly came; to a country which desired to admit him/her or applied for; a persons with a double citizenship to a country of permanent residence or a country which he/she has close relations.
