Information for foreigners and persons without citizenship

The Statute on the special documents of the foreigners and persons without citizenship residing in the Azerbaijan Republic was approved by the low of the National Assembly of the Azerbaijan Republic from December 30, 1997.

  • The document that identifies the personality of the persons without citizenship residing in Azerbaijan is identification document (ID) given them by way and form defined in the legislation of the Azerbaijan Republic.
  1. Identification document given to persons without citizenship not reached 16 age to use within the bounds of the Azerbaijan Republic (an original enclosed);
  2. Identification document given to the persons without citizenship reached 16 age to use within the bounds of the Azerbaijan Republic (an original enclosed);
  3. Identification document given to the persons without citizenship for departing out of the Azerbaijan Republic (an original enclosed).
  • Identification document given to the persons without citizenship not reached 16 age for use within bounds of the Azerbaijan Republic includes serial numbers, first name and last name of the owner, first name and last name of parents, date and place of birth, country arrived from, gender, blood group, place of residence, name of the services issued the ID and the date of issue.
  • Identification document given to the persons without citizenship reached 16 age for use within bounds of the Azerbaijan Republic includes in addition to the showings defined at the item 4 of this Statute the marital status, height, color of eyes, personal signature of the ID owner and his photo. This ID shows only owner’s father’s name instead of parents’ name.
  • the person that don’t have citizenship by reaching 16, 20 age should replace his identification document for use within bounds of the Azerbaijan Republic every 5 year, or in a month in cases of changes concerning the first name, last name, father’s name, place of residence, marital status, in cases of errors on ID, of becoming unfit or of lost.
  • Identification document given to the persons without citizenship for departing out of the Azerbaijan Republic includes the name of Azerbaijan state, state emblem, code of the country, serial numbers of ID, owner’s first name, last name, father’s name, the country arrived from, place and date of birth, gender, blood group, the name of services issued the ID, issued date, ID owner’s personal signature, the name of the children going along with ID owner not reached 18 age, their gender, date of birth, ID requirements  and ID owner’s photo.

The foreigner with desire to reside at the territory of the Azerbaijan Republic for more than 30 days should apply in 3 days from the time of  taking up the place of residence the services of registration at the corresponding territorial police departments or sections in order to be registered at the place of residence.

The official of the registration and ID services should require the following documents along with the second part of the registration sheet for registration of the foreigner at the place of residence:

  • Application-request
  • passport
  • entrance permission (visa) if necessary
  • the warrant (registration document of the property, rent or tenancy contract or other document specified in legislation of the Azerbaijan Republic) that gives ground to settle at the place of residence or the request of the person who tenant the place of residence to foreigner.
  • 2 (two) colored photos of 25mm/30mm size printed from one negative having naked head, full face appearance with features (spectacles, beard, moustache and etc.) and outward appearance of daily nature.
  • ticket of state duty payment, copy of the document proving exemption from payment of state duty by defined way.

After 3 day of applying the foreigner is given registration document on registering at the place of residence. The registration document includes the serial numbers of the document, owner’s full name and surname, place and date of birth, citizenship, gender, the name of services issued the document and date of issue.

The registration period at the place of residence of the foreigner arriving Azerbaijan by official permission (visa) should not exceed his permission (visa) period.

According to the following requirements of the low of the Azerbaijan Republic on Legal status of foreigners and persons without citizenship:

  1. Tax and duties from foreigners and persons without citizenship is fulfilled on the basis of laws of the Azerbaijan Republic and international agreements, of which Azerbaijan Republic is participant. (Article 23).
  2. According to established order of the legislation of the Azerbaijan Republic foreigners and persons without citizenship are responsible for committed criminal, administrative and other delinquencies at the territory of the Azerbaijan Republic.(Article 24)
  3. According to established order of the legislation of the Azerbaijan Republic foreigners and the persons without citizenship are responsible for the following infringements of presence at the territory of the Azerbaijan Republic (Article 25):
  • unavailability of appropriate documents for presence at the territory of the Azerbaijan Republic;
  • residing at the territory of the Azerbaijan Republic with invalid documents;
  • non-observance of the rules of movement, residence selection and registration;
  • infringement of rules when being employed
  • ill-timed leaving the territory of the Azerbaijan Republic on the expiry of presence period;
  • non-observance of rules of transit through the territory of the Azerbaijan Republic.
  1. The presence period at the territory of the Azerbaijan Republic can be reduced for the foreigners and the persons without citizenship violating the requirements of the legislation of the Azerbaijan Republic.

Resolution on reduction of presence period of foreigners and persons without citizenship in the Azerbaijan Republic is adopted by relevant state bodies.

  1. When arises a necessity of ensuring the national security, protection of public order, health, rights and interests of the population as well as when the serious infringement of requirements of the legislation of the Azerbaijan Republic on legal status of foreigners and persons without citizenship takes place, the foreigners and the persons without citizenship can be expelled out of the bounds of the Azerbaijan Republic within 7 days on the basis of resolution of the relevant state body.

Expulsion of the foreigners and the persons without citizenship out of the bounds of the Azerbaijan Republic is fulfilled according to the established order of the Code of the Azerbaijan Republic “On Administrative delinquencies”.

Foreigners and persons without citizenship have to leave the territory of the Azerbaijan Republic within the period defined by the resolution on expulsion out of the bounds of the Azerbaijan Republic. Foreigner and person without citizenship, refusing to leave the territory of the Azerbaijan Republic is arrested on the basis of  a sanction of the Public Prosecutor General of the Azerbaijan Republic and Public Prosecutor of the Nakhchivan Autonomous Republic and is expelled out of the bounds of the Azerbaijan Republic by compulsory way.

Resolution on expulsion of foreigners and persons without citizenship out of the bounds of the Azerbaijan Republic may be appealed at the court. An appeal doesn’t suspend execution of the resolution.

  1. If the international agreements, of which the Azerbaijan Republic is a participant, defines regulations differing from the regulations established by the present law then regulations of the international agreements are applied. (Article 28)
  2. The present law doesn’t affect the rights of persons having diplomatic immunity and privileges on the basis of laws of the Azerbaijan Republic and international agreements, of which the Azerbaijan Republic is a participant. (Article 29)
