Appeal Court upholds decision on MP Abdullayev's imprisonment

30 March 2007 [23:30] - TODAY.AZ
The Appeal Court today upheld the decision of Nasimi district court on parliamentarian Huseyn Abdullayev's imprisonment, Kamandar Nesibli, lawyer for the parliamentarian told.

Huseyn Abdullayev did not participate in the court proceeding, APA reports.

The lawyer said that the court linked the decision with the fact that Abdullayev;s release can impede the investigation and he can leave the country as he has relations with foreign countries.
The lawyer called the court’s decision unjust and said that he will petition for Abdullayev's release.

"Some inquires were presented. I am waiting for answers. Huseyn Abdullayev was arrested before his parliamentary immunity was annulled. The parliament made a decision about it at about 14.00, while he was arrested at about 10.00. To arrest a parliamentarian at that time contradicts the law," he said.

MPs Fazail Agamali and Huseyn Abdullayev had a conflict at the parliament's sitting on March 16. Fazail Agamali appealed to the law enforcement bodies and said that he was offended and underwent physical pressure.

The parliament annulled Abdullayev's parliamentary immunity at Prosecutor General Zakir Garalov's demand.

A criminal case has been launched against him on Article 221.2.2 (hooliganism) and 132 (beating). Huseyn Abdullayev is being kept in Bayil Detention Place #1.
