"They have not appealed to local courts on their detention conditions and other issues. Therefore, I cannot say whether it is advisable or not to raise this issue at the European Court," Chingiz Asgarov, Azerbaijani authorized representative at the European Court of Human Rights told the APA exclusively.
Mr.Asgarov said if detention conditions are not in satisfactory level, and detainees' rights are violated, they or their lawyers can appeal to the European Court. And the Court demands the responsible state to take relevant measures.
"The lawyers are likely to have appealed regarding this issue," he said.
Asgerov noted in this case, the European Court will send inquiry to the Azerbaijani government, and then decide to take necessary actions.
London lawyers bureau and lawyer Lord Lester took the Azerbaijani government to the European Court related to ex-economic development minister Farhad and his brother Rafig Aliyev. They claim articles 3, 5, 6, 8, 13 and 14 of the European Convention have been violated.
