Azeri government will not pay ECHR-awarded damage to Fahmin Hajiyev

The European Court of Human Rights' judgment on case of former commander of Azerbaijan's Internal Troops is to be implemented till February.

The court decision on Fahmin Hajiyev's considers the implementation of the decision after three months from the date on which the judgment was passed.

Chingiz Asgarov, Plenipotentiary Representative of the Republic of Azerbaijan at European Court of Human Rights, told APA that if the decision is not implemented till midst of March, Azerbaijani government will have to pay percent for this per month.
 
Asgarov noted that Hajiyev does not live in Azerbaijan and that is why it was not defined to what bank account money will be transferred.

"We have not found Hajiyev's address and account yet. Money will be paid after all these defined," he said.

Fahmin Hajiyev who is in Turkey at present told the APA that Azerbaijani government should pay money as well as to consider his case again.

"It does not mean that Azerbaijani government will pay this sum and by this the judgment of the European Court will be implemented. They have to consider my case too," Hajiyev said.

Stressing that he has appealed to the chief of Supreme Court, Fahmin Hajiyev said that he had also appealed to Ministers' Committee of European Council to take control over payment of the compensation and new trial.

"I have given information about my bank account in both letters which have addressed to Supreme Court's chief and Ministers' Committee of European Council. And if Azerbaijani government appeals to Turkey government, the law-enforcement bodies can give necessary information about me," Fahmin Hajiyev underlined.

Asgarov noted that there is no item about consideration of Hajiyev's case again in the decision of European Court of Human Rights.

The judge of the Supreme Court Muzaffer Agazadeh told the APA that European court does not touch on the main point of the case.

"European court only investigates the violation of human rights considered in the European convention. If the rights of the citizen violated, then the court can apply sanction against the state. European Court can not make any court consider somebody's case again," he said.

In his appeal to European Court of Human Rights Fahmin Hajiyev noted that his rights have been violated on 6th, 7th and 14th items of convention on human rights.

Azerbaijani government is to pay applicant EUR 3,000 (three thousand euros) in respect of non-pecuniary damage, plus any tax that may be chargeable; and EUR 2,500 (two thousand five hundred euros) in respect of the costs and expenses.
