Article on criminal liability under car accidents to be amended in Azerbaijan

The sanctions envisioned by the Article on criminal liability under car accidents will be amended in Azerbaijan.

The bill "On Supplements and Amendments to the Penal Code" envisions different, depending on the gravity of damage, sanctions for harming a suffered persons as a result of careless driving.

Under the proposed change, for an insignificant damage to a suffered person as a result of violation of road traffic rules and exploitation of a transport vehicle (Article 263.1), an offender can be deprived of driving license for a period of 2 years or fined to 5,000-7,000 manat or sentenced to correctional works or sentenced to 2 years in prison.

At the moment, the period of correctional works or deprivation of driving license is 3 years, and such punishment is applied in the cases of both heavy and light damage.

According to the proposed changes, an offender is sentenced to 3 years of correctional works or is deprived of driving license only in the case of heavy damage to a suffered person.

The bill was examined by the Parliament’s Committee on Legal Policy and Statehood Issues and submitted for consideration to the Parliament of Azerbaijan.
