Brief historical overview.

A Constitution Act on state independence was adopted in Azerbaijan on October 18, 1991. An irregular session of the Supreme Soviet of Azerbaijan adopted on 30 August 1991 a Declaration on rehabilitation of the state independence.

"Guiding with the high state interests if the people of Azerbaijan and expressing the will of the nation, noting the existence of the Azerbaijan Republic as an independent state recognized by the world community and based on the Constitution, Constitutional law on sovereignty of the Azerbaijan Republic and economic independence, realizing a responsibility for the fate and provision of independent development of the nation, guaranteeing the right of the Azerbaijani citizens, specified by the international acts of human rights and freedom irrespective on the nationality and religious beliefs, striving for prevention of sovereignty and territorial integrity of Azerbaijan, guiding with a sacred duty of ensuring the security and inviolability of the state borders of Azerbaijan, realizing the necessity for consolidation of patriotic forces of the country, recognizing the international pacts, conventions and different documents, not contradicting the interests of the Azerbaijan Republic and its people, desiring to preserve the friendly relationships with all countries entering the Union of Soviet Socialists Republics, voicing readiness for the establishment of equal relationships with the member-states of the international community, being hopeful for the recognition of the state independence of the Azerbaijan Republic by the member-states of the international community and the United Nations in line with the principles secured in the UN Charter, different international-legal pacts and conventions, the Supreme Soviet of Azerbaijan proclaims the restoration of the state independence of the Azerbaijan Republic," the document said.

In pursuance of the resolution, basing in the Declaration on Independence adopted by the National Council of Azerbaijan on 28 May 1918, and guiding the Declaration on rehabilitation of independence of the Azerbaijan Republic adopted by the Supreme Soviet of Azerbaijan on 30 August 1991, on 18 October 1991 the Supreme Council of the Azerbaijan Republic adopted a Constitutional Act on State Independence and established the base of the state, political, and economic structure of the independent Azerbaijan Republic. Since that date Azerbaijan has acquired its state independence, while 18 October has been marked as the national independence day.
