Plenary session of Azerbaijan's Constitutional Court was held on Monaday.

The session focused on the final documents on the results of the partial re-run of the parliamentary elections (13 May, 2006) submitted by the Central Election Commission (CEC).

The Judge Rafael Gvaladze said the relevant documents were required from the Supreme Appeal Courts and Prosecutor's Office of Republic to check the final protocol presented by the CEC. The judge also noted that local courts reviewed 1,745 appeals about voter's lists, which did not include some voters' names. 1740 appeals were satisfied. The Court of Appeal received 17 cases on the repeat elections. Eleven were about annulling of candidacies, seven CEC’s decisions and eleven were appeals on the results of the elections. The Supreme Court received eight appeals. Three of them were made by parliamentary candidates due to dissatisfaction of the CEC's final protocol. The Court will reconsider seven complaints and gave the rest one to the Court of Appeal for reconsideration.

Gvaladze also said the Prosecutor's Office of Republic received 20 complaints on voting irregularities. 14 of them were submitted to relevant instances, four were dismissed and criminal case was launched regarding two appeals. These are about hooliganism of candidate on Surakhani Constituency 2 #31 and the other about interference in electoral process in the precinct #15 of the constituency.

The CEC chairman Mazahir Panahov addressing the session, said that the voting results in four of 343 precincts were annulled on the basis of complaints. Mr. Panahov said there were no illegalities regarding registration of parliamentary candidates and the election campaign. No complaints were made about it.

The CEC vice-chairman Svetlana Gasimova said there were 566 cases related to non-inclusion of names in voter's lists and this is trifle. Thus, between 10 and 15 thousand complaints were considered in elections last year. Stating that there were active election campaign regarding the repeat elections, Gasimova said the CEC members held 92 TV debates and over 500 relevant articles were published.

The Constitutional Court chairman Farhad Abdullayev announced the decision of the court. He reported that 141,559 of 392 033 voters participated in the vote in the re-run of the parliamentary elections. The court has reviewed information of relevant court and law enforcement bodies. According to the court's decision the results of the repeat parliamentary elections were recognized in Binagadi ConEC #9, Surakhani ConEC 2 #31, Nizami (Ganja) ConEC #38, Sumgayit ConEC 2 #42, Sumgayit-Absheron ConEC #44, Jalilabad-Masalli-Bilasuvar ConEC #69, Gadabay ConEC #103, Tovuz-Gazakh-Aghstafa- ConEC #106, Zagatala ConEC #110, Aghdam village ConEC #119.

So the elected candidates are: Rafail Jabrayilov on Binagadi ConEC #9, Ahmad Valiyev on Surakhani ConEC 2 #31, Asef Hajiyev on Nizami (Ganja) ConEC #38, Majid Karimov ConEC on Sumgayit ConEC 2 #42, Baba Taghiyev on Sumgayit-Absheron ConEC #44, Fazail Ibrahimli on Jalilabad-Masalli-Bilasuvar ConEC #69, Rafig Mammadhasanov on Gadabay ConEC #103, Ilyas Ismayilov on Tovuz-Gazakh-Aghstafa-ConEC #106, Hikmat Atayev on Zagatala ConEC #110 and Bakhtiyar Sadigov on Aghdam village ConEC #119.
