Prosecutor General's Office of Azerbaijan started crime case on the facts of severe violations of electoral legislation in Binagadi ConEC2 #9 and Sumgayit ConEC 2#42. The election results from both are announced unreliable under article 308.1 (abuse of duties) and 161.1 (forgery of election documents, miscounting of voices purposely, breaching the rule on secret voting) of the Criminal Code.
According to the information from Prosecutor General’s Office, the Investigation Department on Grave Crimes of Prosecutor General’s Office found that the chairman of Binagadi ConEC2 #9 Zahid Janayev, the head of the precinct election commission #20 Zidadkhan Budagov, the chairman of Sumgayit ConEC 2#42 Tofig Abdullayev, the head of precinct election commission #17 Shukur Azimov abused their official duties during the November 6 parliamentary elections. They acted against the constitution of Azerbaijan, violated acts of legislation on ensuring the citizens of Azerbaijan to exercise their rights to elect officials to the state organizations generally, equally and directly by free, personal and secret voting and damaged the interests of the state on ensuring these rights in accordance with the legislation. The above mentioned officials organized falsification of some facts in the protocols, forged the official election documents on the results of the voting. As the result, these illegalities prevented defining the will of the voters objectively while evaluating the results of the elections on the constituency. Z.Janayev, Z.Budagov ,T.Abdullayev and S.Azimov were detained as suspects by the investigation organs for their actions. The CEC filed a request to the General Prosecutor Office to investigate law violations not permitting to determine the will of voters in the precincts # 8, 13, 17, 18, 20, 22, 23, 24, 25 and 28 of the Surakhani second election constituency # 31. When respective materials concerning this appeal were reviewed, criminal signs were revealed in actions of the chairmen and members of those precinct election commissions and the decision dated on 09.11.2005 was adopted on implementing criminal prosecution of those persons under the articles 308.1 and 161.1 of the Criminal Code.
