Azerbaijani courts need to be authorized to deny the right of persons, convicted for heinous crimes, to pardon.
MP Gudrat Hasanguliyev made this proposal when he was speaking at a meeting of the Parliament’s committee on legal policy and statehood issues on Tuesday.
"This is practiced in many European countries. For example, our countryman Ramil Safarov was deprived of the right to pardon by court in Hungary. If this provision takes effect, even the president will not be able to pardon a person who is deprived of the right to pardon," the MP said.
Hasanguliyev suggested tightening punishment measures for rape, premeditated murder, violence against underage persons, and other grave crimes.
The MP also suggested establishing the institute of assessors who are to give oath and stated that the use of such institute had produced fruits in many countries.
MP Ilyas Ismailov said he did not share the idea of softening penal legal provisions and that changes of the Penal Code should be made primarily with respect to the interests of the community.
MP Rafael Jabrailov believes that it is necessary to tighten punishment measures. The MP suggested replacing punishment in the form of imprisonment by punishment in the form of high fines.
The Committee’s Chairman Ali Huseynli stated that the proposals had been taken into account and would be submitted for consideration to a Supreme Court’s working group.
At the yesterday's meeting, the Committee examined the bills "On Adding Changes to the Penal Code" and "On Adding Changes to the Code of Execution of Punishments". It was proposed to amend Article 101 of the Penal Code.
