Azerbaijani Presidential Administration: Legislation is brought into conformity with European conventions in process of implementation of European Court decisions

The legislation is brought into conformity with the European conventions and case law in the process of implementation of the decisions made by the European Court regarding Azerbaijan, the head of department on work with law-enforcement agencies of the Presidential Administration of Azerbaijan Fuad Alasgarov said during the international conference "Actual problems of building legal state, judicial training and development of legal science in Azerbaijan".

"Implementation of the European Court decisions gives reasons for certain changes in the legislation and its introduction," said Alasgarov. According to him, the decisions of the European Court determined compensation in connection with a specific offense, the elimination of certain voids and gaps in national legislation and practice.

Concrete work is carried out to eliminate voids and gaps in the national legislation, said Alasgarov.

In the phase of communication with the European Court, the legal provision on prisoners' correspondence with their lawyers has been harmonized with the case law of the European Convention and the European Court.  

If earlier the messages received or sent by prisoners necessarily passed censorship, after the changes, they can be verified only in the case of preventing imminent crime, the prosecution, the rules of punishment and security for the life of individuals.

The European Court has made 24 decisions regarding Azerbaijan.
